Probate

How much does probate cost?

We charge for the time our probate lawyers spend dealing with the matter at a rate of £312.00 plus VAT at 20% per hour, but with no additional fee based on the value of the estate.
The general price range for Probate would be:-

  • Simple estate: £3,300 – £8,250 plus VAT at 20%
  • Medium complexity estate: £8,250 – £27,500 plus VAT at 20%
  • High complexity estate: £27,500 – £82,500 plus VAT at 20%

Usually, a simple estate is one where there is a house, some bank accounts, and no disagreement between the beneficiaries.
However, more complex estates may involve IHT, foreign assets, companies, farms, or disputes against the estate.

There are additional fees of
£15 + VAT per executor and beneficiary for ID checks
£45 + VAT for each transfer of funds needed

What can we advise about:

  • Who should obtain the grant if more than one executor has been appointed? Bearing in mind the personal liability of  those who become executors, we can advise on the ability to “renounce” or to have power “reserved” to avoid  such
  • How can the inheritance tax be paid (and complete the direct payment scheme form )? It needs to be paid upfront to obtain the grant.
  • The ability to pay some inheritance tax in 10 annual instalments.

Before we advise on such matters, we will give you a cost estimate for your approval.

The following factors are likely to increase the cost:

  • Not having all the paperwork available or incorrect information that needs investigating and correction.
  • Third parties are not responding to communications promptly.
  • Dealing with unusual or complex assets (for example, fine art, timeshares and shares in private companies)
  • The will’s validity is disputed, or a claim is made for financial provision.

If complications arise, we will discuss them with you and agree on the fee for the additional work before it is undertaken.

We can also advise various inheritance tax reliefs:

  • The individual allowance, which everybody has of £325,000, and a “residence” allowance of £175,000 if the criteria are met.
  • Using these two reliefs on the second death of a married couple (if not been utilised on the first death) to make a total exemption on the second death of £1 million.
  • Business relief is available at 100% on many shares not quoted on the main stockmarket, as is “agricultural” property relief if the relevant criteria are satisfied in both cases.

Before we advise on such matters, we will give you a cost estimate for approval.

Additional aspects

We can agree on fees for additional aspects that might be required, such as:

  • A deed varying the will. The cost will likely be £500 plus VAT at 20%, but an exact figure can be given.
  • The notice on an executor to whom power is reserved to obtain a grant of £156 plus VAT at 20%
  • A deed under which an executor renounces his or her right to obtain a grant of £175 plus VAT at 20%
  • The document (an assent) transferring ownership of property under the terms of the will is £600 plus VAT at 20%
